Senate postpones Mylan hearing after CMS, Mylan & DOJ refuse to send officials — 5 notes

The U.S. Senate Judiciary Committee had to postpone a hearing to discuss Mylan allegedly underpaying the government, according to Reuters.

Here are five notes:

1. The committee postponed the hearing as Mylan, the Department of Justice and CMS refused to send officials to the Nov. 30 hearing.

2. The hearing is assessing whether Mylan underpaid the government by misclassifying EpiPen.

3. Last week, Mylan Pharmaceuticals' attorney sent a letter to Sen. Chuck Grassley (R-Iowa), chair of the Senate Judiciary Committee, saying the company will not testify at a Senate hearing for three reasons, with the first reason listed as the "stated focus of the hearing."

4. Additionally, Mylan refuses to testify because the case is a pending matter and the DOJ and CMS previously stated they are not sending officials to testify.

5. Regarding the committee's decision to postpone the hearing, Sen. Grassley said, "Unfortunately, because of the unconventional refusal by these three entities to attend, we must now consider compelling their participation. This committee will not stop until our questions are answered and any appropriate actions are taken."
