3 legislative updates for ASC leaders to know — Sept. 21, 2017

The following legislative changes or possible regulatory updates may impact various parts of the healthcare industry, including ASCs.

Here are three to consider:

Florida Senate to consider ASC 24-hour stay bill
During the 2018 legislative session, the Florida Senate will consider a bill permitting 24-hour stays at ASCs. Sen. Greg Streube, R-Sarasota, filed the bill.

Graham-Cassidy ACA Repeal Bill would cause rates to rocket for people with pre-existing conditions
The latest attempt to repeal the ACA, the Graham-Cassidy ACA Repeal Bill, would drastically cut Medicaid, eliminate ACA-related subsidies and raise premiums for everyone purchasing coverage through exchanges.

150+ Texas ASCs comment on CMS OPPS rule; support moving cardiac procedures to ASCs
In its 2018 Outpatient Prospective Payment System Proposed Rule, CMS stated it was open to considering adding some cardiac catheterization services, cardiac device programming services and electrophysiology services to its covered surgical procedure list. The bill would eliminate ACA-imposed penalties on uninsured individuals or employers. CMS posted 482 comments it received on the proposed rule Sept. 6. Of these comments, Texas ASCs comprised more than 150.  In the comments, ASC representatives supported CMS allowing cardiac procedures in ASCs.
