Anesthesia Business Consultants asks anesthesiologists to review new CMS booklet: 5 things to know

Anesthesia Business Consultants is encouraging anesthesiologists to review Avoiding Medicare Fraud & Abuse: A Roadmap for Physicians, a 20-page booklet recently released by CMS.

Here are five things to know:

1. The booklet includes an overview of current fraud and abuse laws, alongside resources for finding additional information and future assistance with problems.

2. This information not only serves to help anesthesiologists and other physicians protect themselves, but also to clarify what steps they should take if they discover suspected fraud or abuse.

3. Anesthesia Business Consultants draws particular attention to seven relevant federal laws: Federal False Claims Act, Overpayments Rule, Anti-Kickback Statute, Physician Self-Referral Law, Criminal Health Care Fraud Statute, Exclusion Statute and Civil Monetary Penalties Law.

4. The booklet also includes an overview of the Open Payments Program, a transparency law that requires pharmaceutical, medical device and other companies to publicly report gifts and payments given to physicians.

5. Anesthesia Business Consultants notes: "Failure to understand current laws or how to take the appropriate steps could expose you to risk without your even realizing it."
