This article discusses current issues related to ambulatory surgery centers ("ASC"). This month we review (1) safe harbor concepts under the ASC Safe Harbor; (2) serving out-of-network patients by ASCs; (3) selling shares to new ASC investors; (4) lease issues regarding new types of leases; (5) policies for non-convered procedures; (6) tax-exempt joint venture issues; and (7) antitrust price fixing issues.

The establishment, marketing and operation of an ambulatory surgical center ("ASC") is subject to various federal and state laws. The laws concern the kickback, rebate or division of fees between physicians and non-physicians, the recept or offering of remuneration as an inducement to refer patients, false claims, and the manner in which prospective patients may be solicited.

A code of conduct is simply one piece of an overall compliance plan. It puts forth a number of core concepts that should be incorporated into the compliance plan. Often, a surgery center will have a difficult time administering and starting to put together a comprehensive compliance plan.
